Definition of CC&Rs
Definition: CC&Rs refer to covenants, conditions, and restrictions that often come with buying houses, apartments, and other real estatein common interest communities. These communities, such as condominiums and co-ops, have rules that every property owner must follow, such as keeping the grass cut and not making too much noise. The CC&Rs come with the property when purchased and may be changed by the governing body, such as a homeowners’ association (HOA). If someone breaks the CC&Rs, they may receive fines or other penalties that are legally enforceable. It is important to review the CC&Rs before buying a property to avoid any surprises.
For example, if the CC&Rs say that pets are not allowed, and someone buys a property with the intention of bringing their dog, they may be fined or even forced to get rid of the pet. Another example is if the CC&Rs say that all residents must park in designated spots, and someone parks in a spot that is not theirs, they may receive a fine.
