Definition of continuing breach
A continuing breach is a violation of a contractual obligation that endures for a considerable time or is repeated at short intervals. It is a breach of contract that persists over time.
For example, if a company fails to deliver goods to another company on the agreed-upon date and continues to do so for several weeks, it is a continuing breach. Another example is if a landlord fails to make necessary repairs to a rental property, despite repeated requests from the tenant.
Continuing breaches can give rise to claims for damages and other remedies. The aggrieved party may be entitled to terminate the contract and sue for damages immediately or wait until the time of performance has arrived and then call on the other party to perform.
