Definition of decree of furthcuming
A decree of furthcuming is a court order in Scottish law that commands a third party in possession of a debtor's property to deliver the property to the creditor for liquidation or satisfaction of a debt. It is also known as a decree of forthcoming.
For example, if a person owes money to a creditor and has property in the possession of a third party, such as a bank account or a car, the creditor can obtain a decree of furthcuming to force the third party to hand over the property to be sold or used to pay off the debt.
