Definition: Ex causa mandati is a Latin term used in Scots law which means "because of the mandate". It refers to the legal principle that a person who has been given a mandate or authority to act on behalf of another person is entitled to claim reimbursement for all expenses incurred and relief from all obligations incurred in carrying out that mandate.
Example: If a person is given a mandate to sell a property on behalf of another person, they can claim reimbursement for all expenses incurred in the process of selling the property, such as advertising costs, legal fees, and commission. They can also be relieved of any obligations incurred in carrying out the mandate, such as liability for any defects in the property that were not disclosed to them. This is because they acted ex causa mandati, or on account of the mandate given to them.
