Definition of implied reciprocal covenant
An implied reciprocal covenant is a presumption that a promisee has, in return for a promise made respecting land, impliedly made a promise to the promisor respecting other land. This means that if someone promises to do something with their land, the person they made the promise to is also expected to make a promise in return. This promise is not explicitly stated, but is assumed based on the circumstances.
For example, if a developer promises to build a park in a new housing development, it is assumed that the homeowners in the development will also promise to maintain the park and not use it for any other purpose. This is an implied reciprocal covenant.
