Definition:Costs of increase refer to the costs of court awarded in addition to what a jury awards. When a party wins a case, the jury usually awards them only a small sum for costs. If the party wishes to recoup the additional costs incurred by taking the matter through trial, they must file an affidavit of increase setting forth what further costs were incurred.

Examples:

  • After winning the case, the plaintiff filed an affidavit of increase to recoup the costs of hiring expert witnesses and conducting research.
  • The defendant was awarded $10,000 in damages, but also filed for costs of increase to cover the expenses of their legal team.
