Definition of motion for resettlement
A motion for resettlement is a request made to clarify or correct the form of an order or judgment that does not correctly state the court's decision. It cannot be used to request a substantial change to or amplification of the court's decision.
- If a judge issues an order that mistakenly states the wrong date for a hearing, a party may file a motion for resettlement to correct the error.
- However, if a party disagrees with the judge's decision on a matter, they cannot use a motion for resettlement to request a new decision.
