NONACCESS

Nonaccess refers to the absence of opportunity for sexual intercourse. In family law, it is often used as a defense by the alleged father in paternity cases.

For example, if a man is accused of being the father of a child, he may claim nonaccess as a defense if he can prove that he did not have the opportunity to have sexual intercourse with the mother during the time when the child was conceived.

Another example could be a couple who are in a long-distance relationship and have not seen each other for a long time. In this case, nonaccess would refer to the fact that they have not had the opportunity to engage in sexual intercourse due to the distance between them.
