A nonapparent servitude is a type of servitude that is not obvious because there are no exterior signs of its existence. It is an encumbrance consisting of a right to the limited use of a piece of land or other immovable property without the possession of it. Examples of nonapparent servitudes include a prohibition against building above a certain height or a restriction on the use of a property for certain purposes.
For instance, a landowner may have a nonapparent servitude that prohibits their neighbor from building a structure that would block their view. This servitude is not visible from the outside, but it is legally binding and must be respected by the neighbor.
