Definition of particular tenant
A particular tenant is someone who holds or possesses lands or tenements by any kind of right or title. This can include:
- A tenant holding by the custom of the manor
- The person who holds a dominant estate and therefore benefits from an easement
- A person who remains in possession of real property after a previous tenancy (esp. one under a lease) expires, thus giving rise to a tenancy at sufferance
- A tenant of a limited estate taken out of a fee
For example, a tenant who holds a lease on an apartment is a particular tenant. They have the right to possess the apartment for the duration of their lease. Another example is a tenant who holds a limited estate in a piece of land, such as a life estate. They have the right to possess and use the land for the duration of their limited estate.
