Definition of pro rata itineris
Definition:Pro rata itineris (proh ray-tə I-tin-ə-ris) is a Latin term used in Scots law. It means "for the proportion of the journey."
Example: If a ship is chartered to transport goods to a certain port but is unable to complete the voyage, the master of the ship may transship the goods to their destination and earn the full freight. However, if the freighter transships the cargo themselves, the master is entitled to freight pro rata itineris, which means they will be paid for the proportion of the voyage they have accomplished.
Explanation: The example illustrates how the term pro rata itineris is used in Scots law. It shows that if a ship is unable to complete its voyage, the master of the ship may still be entitled to payment for the portion of the journey they have completed. This is known as freight pro rata itineris.
