Definition of psychotherapist–patient privilege
The psychotherapist-patient privilege is a legal right that allows a person to keep confidential any communication made during diagnosis or treatment of a mental or emotional condition by or at the direction of a psychotherapist. This means that the patient can prevent the disclosure of any confidential information to anyone, including the court, without their consent.
For example, if a person sees a therapist for depression, they can share their thoughts and feelings without fear of anyone else finding out. The therapist cannot disclose this information to anyone, including the court, unless the patient consents to the disclosure.
However, there are certain conditions under which the privilege can be overcome, such as when the examination is ordered by a court. In such cases, the patient may be required to disclose the information.
