Definition: Quasi traditio is a legal term from Roman law that means "as if transfer". It refers to a situation where a person acquires a limited right to use someone else's property without following the legal procedures for creating such a right. This can happen when the owner of the property allows the other person to use it informally or without objection.
Example: If a neighbor regularly uses a path across your property to access their own property, and you do not object or give them permission in writing, they may acquire a right of way over your property through quasi traditio. This means that they can continue to use the path even if you change your mind later and try to stop them. The neighbor did not follow the legal procedures for creating a right of way, but they acquired it through your informal permission or acquiescence. This is an example of quasi traditio.
