Definition of restriction requirement
A restriction requirement is a limitation or qualification placed on something. It can refer to:
- A limitation on the use or enjoyment of property, such as a restrictive covenant in a deed.
- A military punishment that involves moral and legal restraint, but not physical restraint. This is called a military restriction and is imposed by a commanding officer's nonjudicial punishment or by a court-martial.
- A ruling by a patent examiner that a patent application comprises two or more patentably distinct or independent inventions. The applicant must elect one invention to continue prosecuting under the original application by abandoning some of the original claims.
For example, if a homeowner has a restrictive covenant in their deed that prohibits them from building any structures taller than two stories, this is a restriction requirement on their property. If a soldier is punished with a military restriction, they may be confined to a specific area but can still perform their duties. If a patent examiner issues a restriction requirement on a patent application, the applicant must choose which invention to pursue and abandon the others.
