Definition: A spite fence is a fence built with the sole purpose of annoying, injuring, or spiting an adjoining owner, usually a neighbor. It can be a division fence or any other type of fence that obstructs the passage of light or air or blocks the neighbor's view.

For example, if a neighbor builds a tall fence right in front of their neighbor's window, blocking their view and natural light, it could be considered a spite fence. Another example is if a neighbor builds a fence that extends beyond their property line and onto their neighbor's property, just to annoy them.

Spite fences are often prohibited by state laws and can be declared a private nuisance.
