Definition of Court of Orphans
A court in Maryland and Pennsylvania that has the power to handle legal matters related to the property and guardianship of children who have lost their parents.
A court that was commissioned by the Crown in England to hear cases of felony and treason. The judges had separate commissions for each court they presided over, and if they had a commission of gaol delivery, they could try all prisoners held in gaol for any offense. In some states, it is a court of higher criminal jurisdiction.
In Maryland, if a child's parents die and they are left with property or money, the Court of Orphans will handle the legal matters related to that property or money. This court will also appoint a guardian to take care of the child's needs.
In England, the Court of Oyer and Terminer was responsible for hearing cases of felony and treason. For example, if someone was accused of murder or plotting against the king, they would be tried in this court. The judges had limited jurisdiction and could only hear cases related to these specific crimes.
