INCOMPETENCY HEARING

An incompetency hearing, also known as a Pate hearing, is a legal proceeding where a court determines if a criminal defendant is mentally competent to stand trial. The hearing is based on the Pate v. Robinson case and is governed by 18 USCA §§ 4241–4247.

For example, if a defendant has a mental illness or disability that affects their ability to understand the charges against them or assist in their defense, the court may hold an incompetency hearing.
